Introduction
Welcome to Tony’s Property Care. By booking our services, you agree to comply with and be bound by the following terms and conditions. Please review them carefully before booking our services.
Recurring Services
By enrolling in our recurring service plan, you agree to a one-year commitment, which includes the initial service, follow-up cleaning(s) at your chosen interval (e.g., monthly, quarterly, semiannual, etc), and a final cleaning at the one-year mark. Since we offer a discounted rate for this plan, early cancellation will incur a $50 fee unless mutually agreed upon by both parties. You may select your service intervals at the time of booking, and any changes to the schedule can be adjusted, but the one-year commitment remains in effect. By proceeding, you acknowledge and accept these terms.
Recurring Service Call Back Policy
Recurring service customers are entitled to up to three (3) complimentary call backs between scheduled window cleaning services. Call backs are intended for minor touch-ups only, limited to spot cleaning of one to two windows, and do not include full cleanings of multiple windows or the entire home. If more than three call backs are requested between scheduled services, we may recommend increasing the frequency of your recurring cleanings to better meet your needs. Should an additional call back be requested after the third visit and the customer chooses not to adjust the service frequency, any subsequent call backs will be subject to a $50 service fee.
Estimates
Estimate pricing is based on questions being answered accurately. If they're incorrectly answered or information is withheld on request form, we reserve the right to adjust our pricing or terminate our estimate/contract completely. Your estimate is good for 30 days only. The schedule of work shall be mutually agreeable to both parties.
Deposits
A 10% deposit may be required at the time of scheduling to secure your appointment and allow us to allocate staff, time, and resources specifically for your service. This deposit helps reduce last-minute cancellations and ensures we can maintain an efficient and reliable schedule for all customers. The deposit is not an additional fee and will be fully credited toward your final invoice upon completion of the service.
Social Media
In today's day and age, social media posts have become a large part of our marketing strategy for business. These include, but are not limited to Google, Yelp, Facebook, Instagram, or any other social platform that allows people to see our work. We use photos and videos to show the services that we perform and can provide. That being said, photos and videos of work done at your property can be used on any of our social media sites. Your privacy is important to us and we will never give out your name, address, or film private areas. If this is something you would like us to avoid at your property, please bring it to our attention at any time and all recordings will stop.
Safety Policy
Safety is our number one priority. Despite best management practices, any cleaning operation has inherent risks inside the work area and as such, customer agrees to hold Tony's Property Care harmless for any damage or hardships as a result of our services including but not limited to: electrical, various glass and hard surfaces, sensitive plants, slip and fall claims, chemical burn, water leakage, etc. Due to insurance liabilities, we are unable to move obstacles such as but not exclusive to flower pots, garden furniture etc.
Minors
We require an adult to be present at all times when a minor is home. If we show up to a job where a minor is home alone, our cancellation policy will go into effect and you will be charged accordingly. The home can be vacant but please let us know beforehand and give us direction to access.
Service Refusal
We prioritize safety and quality above all else. Consequently, we reserve the right to decline service for any project that poses an undue safety risk or exceeds our current technical scope of work.
Cancellation
We require a minimum 24 hours notice for cancellations. Cancellations with less notice will be subject to deposit not being refunded.
Rain
Rain happens. Please follow our cancellation policy in the event of rain. If you're scheduling during the rainy season and you know you'll cancel then please reschedule for a different time of year and within our cancellation policy. Dirty surfaces create dirtier surfaces in the rain and clean surfaces are clean in the rain.
Pets
We know you love your pets, and so do we. But we've still got a job to do. Please keep your pets in a safe place so we can work without interruptions. Remember that your pets act differently around strangers when you're not there. Please don't leave us in a vulnerable situation. Our job may require us to open windows, doors, gates, and require us to access different areas of your property. Please have a plan to let us access the areas we need uninterrupted and keep your pets safe. All of our jobs have budgets so we may have to raise your price if we are spending extra time on this matter.
Satisfaction
We want you to be happy. If you're not completely happy with our work we will try to come out and make it right. We ask that you please communicate with us so we can learn and fix any issues that arise. We strive to provide the highest quality of service. If you are not satisfied with the service provided, please contact us within 48 hours, and we will address your concerns. In the event that no issue is brought to our attention within 48 hours, the job will be considered complete and the client will be deemed satisfied.
Re-cleaning
If you are not satisfied with the cleanliness of your windows or home, we will touch them up at no additional charge, provided that the complaint is made within 48 hours of the initial service.
Payment Terms
All payments are due on completion of work unless otherwise agreed upon in writing. If your invoice goes past 30 days, you will be subject to 1.5% interest per month from invoice price. Accepted payments are cash, check, Venmo, Zelle, and all major credit cards. In the event that you fail to pay an outstanding balance within 90 days of receipt, your account will be suspended and your details will be passed along to a collections agency. You will then be liable for all related charges, collection agency fees and court related fees.
Price Match
Everyone wants a good price, including you. We will do our best to price match any written estimate you receive from a competitor that has the same credentials as us. The scope of work has to be exactly the same, no more, no less.
Price Raises
No one likes prices going up, we get it. Unfortunately business expenses go up annually due to inflation and other factors. To keep our business financially healthy we reserve the right to raise prices. This could mean a price change on your original service, next service, or multiple services later. You will be notified of price changes before any work begins.
Exclusions
Exclusions on all projects unless otherwise specified: Additionally insured certificates, waiver of subrogation, permits, bonds, inspection fees, water supply/source, traffic control / lighting, dust control, trash hauling, drilling or screwing (screen installation), standby of other contractors, overtime / night work, trash receptacles / hand washing station / portable restrooms, any work unless specifically included in estimate.
Access
Access must be granted to all places requiring admission, codes or other access procedures for the purpose of our work including access to water and bathrooms. Should we be unable to access any part of your property due to locked gates or any other obstruction, we will clean the accessible areas such as the front & sides and charge accordingly. If we cannot access your property for the agreed upon service you may be subject to rescheduling fees or extra waiting costs.
Special Equipment
Special equipment needed to complete a project will be billed at rental cost and all associated expenses plus 15%. You will be notified in the event special equipment is needed.
Other Expenses
Customer or contractor shall pay for any and all waiver of subrogation or bonding requirements, special insurance or insurance requirements beyond what we hold for insurance limits and any other special requirements required on their specific project.
Accidental Damage
We ask that you move valuables and breakables before our arrival. Our company will replace anything in the event we accidentally break something while working. If something breaks while it's being used as designed then the customer will be responsible.
Example: We drop a tool and it breaks a window, we will replace the window.
Example: We open the window as designed and the window slams shut and breaks, the customer will be responsible. Sometimes things just break and we were the next one to touch it.
Client’s Duty to Disclose Issues
The Client agrees to disclose any known issues with the property that may impact the Service Provider’s ability to perform the services, including but not limited to structural problems, water damage, cosmetic defects, faulty outdoor appliances and outlets, unsafe conditions, or pre-existing damages to roof, windows, stucco, siding, electrical outlets, gutters, etc.
Notice of Damage
Notice of Damage: It is the customer’s responsibility to promptly report any damage to windows or any other area of the property that they believe was caused by our work. Any such damage must be reported to Tony’s Property Care within 24 hours of service completion. After this 24-hour period, the work will be considered complete, and the customer will be deemed satisfied.
Common damage we see:
Scratches
Some surfaces on the property aren't perfect. When it's dirty or in different lighting, you can't see imperfections. It's common for scratches or other blemishes to be revealed after the glass, siding, frames, or any other surface is cleaned. Rest assured we don't use any equipment, supplies or methods that cause these issues. Scratches can come from a factory, supplier, transportation, installer, numerous tradesmen during construction, pets, or someone simply bumping into it. Our company is not liable for scratches.
Bent Screen
Screens are commonly bent from someone putting pressure in the middle of the frame. Screens also sit in the sun and naturally deteriorate over time. We will remove all screens properly without putting pressure in the middle of the frame and return them the same way. We will not be liable for bent or ripped screens unless we accidentally caused it.
Broken Seals
Broken seal or failed seal is a term used to describe a bad seal around the window that allows moisture to build up inside. These are common on all types of windows and eventually happens to all dual pane windows. The more harsh weather or sun a window gets, usually the faster the seals go bad. No one can cause a broken seal. If your window looks foggy or has moisture in it, you most likely have a broken seal. Our company is not liable for broken seals.
Hard Water Spots or Mineral Staining
Hard water on glass is from water drying out and the minerals being left behind to cause stains. Depending on how severe the minerals are, how much sun the area gets, how consistently it gets wet, what kind of minerals are in the water, how long it's been on the surface and other factors will determine if the stains will come out. These are common from sprinklers, hosing or pressure washing a house, condensation on windows, rain, watering plants etc. Make sure that you avoid getting your windows wet as much as possible and try to get them cleaned as soon as possible after. Soft water will still leave damaging stains and should not be used on your glass. We use special techniques and supplies to remove what we can on the surface of the glass. If the stains are deeper than the surface then you may need to replace the glass or hire a restoration company. Our company is not liable for hard water spots or mineral deposits.
Roofing
Whether it be tile, cement, or shingles. Eventually roofing materials begin to fail due to age, weather, previous contractors who worked on the roof or installed it, and any other factor.
Stucco
Over time, the bond that holds the stucco to your walls can begin to fade, crack, or bubble from moisture or weather. Sometimes this damage can be hidden under years of dirt, grime, or organic growth. In the event this is noted on an inspection, that area will be marked and made aware to the client. This area will be avoided unless otherwise requested to be washed, regardless of possible damaging outcome, at the client's request.
Wood Damage
Living in the warm, coastal climate of Southern California, we have the privilege of year-round sunshine and mild winters. It also means that termites, dry rot, and other factors that play into wood destroying organisms thrive in this area. These pests and issues destroy the integrity of wood members all across homes, including the siding, eaves, wooden frames, and anything else made of wood. Most of the time, the damages that are caused by these organisms and issues can go unnoticed and may be difficult to spot. It is recommended to have a pest control company come out and address the underlying issues at the client's cost. In the event that any area of concern is noticed, this area will be avoided unless otherwise requested to be washed, regardless of possible damaging outcome, at the client's request.
